Terms of use
These terms are between AquaOps ("we", "us") and you, and cover this website and the AquaOps service. If you use the service for a company, you accept them for that company ("the customer") and confirm that you may do so. If the customer has also signed an order or agreement with us, that document applies first where it differs. Please read our privacy notice with these terms.
1. The website
The information on this website is general. We try to keep it correct and to say clearly what is available, in beta, in early access or only planned. It is not an offer or advice. Features, plans and prices can change; please ask us to confirm anything you depend on. We are not responsible for other websites we link to.
2. The service
AquaOps is software for water treatment companies: clients, sites and systems, jobs and scheduling, maintenance plans, technician apps, a customer portal, quotes, invoices, payments, stock, support tickets and reports. What a customer can use depends on its plan. Beta and early-access features (such as the Android app beta and device monitoring early access) are offered as they are, may change or stop, and should not be the only way you run critical work.
3. Accounts
- An account belongs to one person. Keep your password and two-step codes private, use a strong password and tell us at once if you think someone else has used your account.
- The customer chooses who gets an account and what role they have, and is responsible for what its people do. Give true information when you sign up or are invited.
- You must be at least 18 and allowed to bind the customer.
- We may suspend an account that is a risk to the service or to others, and we tell the customer when we do.
4. Acceptable use
You agree not to:
- break the law, or use the service to harm, deceive or harass anyone;
- try to see another company's data, or get around roles, limits or security;
- upload malware, send spam or misuse the contact form, invitations or notifications;
- overload the service, scrape it, or copy or resell it without our written permission;
- track a person without having told them and having a lawful reason. A company that uses location tracking must tell its technicians and follow the law on privacy.
We may remove content or limit use that breaks this section.
5. Fees and online payments
- Plans. Prices are agreed with the customer in writing before it is charged; none are published on this website. Prices exclude VAT unless we say otherwise. We tell the customer in advance before a price changes.
- Online payments. A customer's clients can pay its invoices online by card or bank transfer through Paystack. Paystack handles the payment and its own terms apply to the payer. The money is credited to the customer's online balance in AquaOps, less a platform commission that depends on the customer's plan, which we state in writing. On each invoice or quote the customer chooses whether the client pays the processing fee, and it is shown on the document.
- Withdrawals. The customer withdraws its balance to a bank account that has been checked by name. A new account, or a change to one, is held for a safety period, and we may delay, hold or refuse a withdrawal that looks fraudulent, is required by law or by Paystack, or is in dispute. A withdrawal fee may apply and is shown first.
- Refunds and disputes. A payment is between the customer and its client. The customer deals with refunds, chargebacks and complaints about its own work. We do not give tax or legal advice: the customer is responsible for its own VAT and tax duties.
- We are not a bank. Online payments may be turned off, in whole or in part, for a company or for everyone, where the payment provider or the law requires it.
6. Your data
- The customer's data is the customer's. This includes its clients, sites, jobs, files and invoices. We do not claim ownership of it. We use it only to provide the service, keep it safe, fix problems and meet legal duties, and we do not sell it.
- Controller and processor. For personal data of the customer's clients and people, the customer is the controller and we are the processor, acting on its instructions. The customer must have a lawful basis to give us that data and must tell people how it uses it. We keep data apart company by company, apply the measures described on our security page and tell the customer without undue delay of a breach that affects its data. The outside services listed in the privacy notice act as our sub-processors.
- Getting data out. Lists such as invoices, payments, tickets and stock can be exported as CSV files. Ask us for a fuller export, including when the customer ends its use.
- Feedback. If you suggest an improvement, we may use it without payment.
7. Our content and the product
The software, text, logo and design belong to AquaOps or are used with permission, and photographs credited to others are used under their stated licences. While the customer has a plan, we give it a limited, non-exclusive right to use the service for its own business. That right cannot be transferred.
8. Availability and changes to the service
We work to keep the service running and to protect it, and we monitor it. We do not promise that it will always be available or free of mistakes: there may be maintenance, outages and fixes, including problems with services we depend on, such as networks, email and payment providers. The service is young software and is still improving. We may change or retire a feature, and we will try to warn customers first when a change is large. We make no promise of a particular uptime or response time unless an order signed by us says so.
9. Responsibility
- The service helps a company run its work. The customer is responsible for its own jobs, water quality results, safety, advice to its clients and legal duties. Readings and bands are tools, not a guarantee that water is safe.
- To the extent the law allows, we are not liable for indirect or consequential loss, lost profit or lost business, or for events outside our control.
- To the extent the law allows, our total liability for any claim is limited to the fees the customer paid us for the service in the 12 months before the claim.
- Nothing here limits liability that cannot be limited by law, for example for fraud, or for death or personal injury caused by negligence.
- The customer will cover us against claims from third parties caused by its unlawful use of the service or by data it had no right to give us.
10. Ending
A customer may stop using the service at any time by telling us; an order may set a minimum period. We may end or suspend access if these terms or an order are seriously broken, if fees are not paid after notice, or if the law requires it. When access ends, the customer can ask for its data as described in section 6, and after a reasonable period we delete or anonymise it, except where the law or fair record keeping (for example invoices and the activity log) means we must keep some. A person may also leave a company, or close their own account, from inside the service.
11. Changes to these terms
We may change these terms. We will tell customers by email or inside the service when a change matters. If you keep using the service after a change takes effect, you accept it; if you do not agree, stop using it and tell us.
12. Law and disputes
These terms are governed by the laws of the Federal Republic of Nigeria. We would like to settle any disagreement by talking first. If we cannot, the courts of Nigeria can decide it. Contact: support@aquasops.com.
